PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE SITES
1. Please read the following terms and conditions carefully.
This agreement (the “Terms of Use”) is a legally binding contract between You (“You” “You” “Your”) and CIS’s units, divisions, subsidiaries and strategic partners (“CIS” “We” “Us » «Us»). This agreement governs your use of any Website or Website operated by CIS and its affiliates, including any website through which you enter this agreement (collectively, the “Websites”).
Through the Sites, CIS offers access to certain services and goods (collectively, “Goods”), as well as certain services, including, but not limited to, corporate and investor news, hotel and casino related information, accommodation reservation services , restaurants and entertainment programs, enrollment in membership programs, Club enrollment, advertising and special promotional offers, including employment, merchandising, online magazine, online sources and registrations for vendors and travel agents, and online applications for cooperative credit cards (collectively , “Services”).
You must read, agree to, and accept all terms and conditions contained in these Terms of Use governing the sale and delivery of any Goods and/or access to and use of the Services, and the Privacy Policy which includes those terms and conditions expressly set forth below and the terms and conditions incorporated by reference, before you may become a visitor (“Visitor”) of the CIS Sites. When you access the Sites and/or the Goods and/or the Services, you accept the terms and conditions as set forth in these Terms of Use. If you do not agree, you may not use or access the Sites or Services, or purchase Goods.
Two types of users may access the Websites – users who enter the Websites without uploading or uploading information to the Websites or accessing password-protected services (such as reservations), and Visitors. Password protected services are only available to Visitors. Without limiting the foregoing, password-protected services are not available to persons under the age of 23, or to Visitors who have been temporarily or indefinitely blocked or self-blocked. If you are not authorized, you will not be able to use or access the Sites, Services or obtain Goods.
CIS reserves the right to periodically change these terms and conditions and/or the Goods and Services at its discretion by posting the terms and conditions, the Goods and Services on the Site. Your use of the Sites after any changes have occurred means that you agree to follow and be bound by the modified terms and conditions of these Terms of Use.
The licenses granted in this Agreement terminate automatically without further notice if you breach any of the terms of this Agreement. Upon such termination, you immediately agree to destroy any materials you have uploaded and/or printed. Unauthorized use of any material contained on this website may violate national or international copyright and related rights laws, trademark laws, personal privacy and disclosure laws, and communications regulations and provisions.
2. Passwords and Security
You must have a Guest account to access certain portions of the Sites and/or Services. Only authorized and registered persons with CIS may enter the Sites and/or Services. To open a user account, you must complete the registration process by providing CIS with current, complete and accurate information as directed by the applicable registration application. When you register for the Services, you agree to submit accurate, current and complete information about yourself and Your organization, if any, and to promptly update such information as necessary. If CIS suspects that such information is untrue, inaccurate, out of date or incomplete, it has the right, but not the obligation, to suspend or terminate your access to the Sites or use of the Services and/or to seek up-to-date data from you.
When you first log into the Services, you may be asked to choose a personal non-transferable password: you may be asked to provide confidential information of your choice (such as maiden name, pet name, city of birth, etc.) which will be used by CIS to verify your identity should you request it if you forget or lose your password. This personal data is not given to third parties, with the exception of the cases provided for in the Personal Data Protection Policy and subject to the terms of the then applicable (up-to-date) Personal Data Protection Policy or the Websites.
We may use cookies to verify the identity of users when they register on the Sites. However, because verifying user identity on the Internet is difficult, CIS cannot verify anyone’s purported identity.
You are solely responsible for any and all activity recorded in your account and must ensure that you log out or log out of your account at the end of each session. If you are using a shared computer or a computer that may be accessed by more than one person, please ensure that you follow all relevant instructions to ensure that you are sufficiently logged off and exited from the Sites and the computer system you are using so that you do not allow others to access your account.
3. Limited Rights
The elements of the Websites are provided with “Restricted Rights”. Use, copying or disclosure is subject to restrictions as detailed in applicable laws and regulations.
4. Information on Products and Pricing Policy, Availability and Employment
CIS is not responsible for typographical or other errors or omissions in pricing or other information. All product sales and advertising are subject to these Terms of Use. Promotional offers and prices are valid for a limited or specified time. Prices and promotional offers are subject to change without notice. Inventory and availability are subject to rapid change. Also, career opportunities on the Sites are subject to change without notice. Please consult individual CIS sites for current information.
5. Your conduct
You agree not to:
A. You upload, transmit, post, send or otherwise make available on the Sites or Services any content or material that: (i) is false, inaccurate, misleading, fictitious, illegal (including under consumer protection laws; , unfair competition, anti-discrimination or misleading advertising), harmful, threatening, coercive, harassing, tortuous, defamatory, immoral, vulgar, provocative, content or material that invades the privacy of others, libelous and/or objectionable, ( ii) infringes any third party’s intellectual property, whether copyright, patent, trademark, trade secret, copyright or other proprietary right or right of publicity or privacy, or (iii) contains viruses, worms, Trojan horses horsepower), Time bombs, cancel bots, Easter eggs, corrupted files, or other similar software or programs designed to interrupt, interfere, intercept, expropriate, destroy or limit functionality of data, personal data, computer software or electromechanical means or telecommunications equipment.
B. Alter, remove or falsify definitions or other designations of origin or source of ownership of any content contained on the Sites or available through the Services or contained in a file uploaded to the Sites or Services.
C. Impersonate another person or company, including but not limited to CIS executives, or falsely state or misrepresent your affiliation with a person or company.
D. Attempt, by any means, to gain unauthorized access to the Sites or Services, or to any user’s account on the Sites and/or Services
E. You use any robot, spider, scraper or other automated or manual means to process or monitor the data or content of the Sites without our prior written approval. You may not systematically retrieve data or other content from the Sites to create, compile, directly or indirectly, a collection, variety, database or guide without our prior written approval.
F. You take any action that imposes an excessive or disproportionate burden on the infrastructure of the Sites and/or Services.
G. You pose a risk to CIS or cause the loss (partial or total) of information technology services provided by partners or other providers of CHL, or
H. You complete transactions initiated using the Services that, by paying a trust or other price, would cause CIS to violate any applicable laws, statutes, regulations or ordinances, or that violate these Terms of Use or the Privacy Policy.
The use of any device, software that interferes or attempts to interfere with the proper functioning of the Websites or Services is expressly prohibited.
6. Limitations on Ownership Rights
A. All material found on the Websites, including – but not limited to – all informational texts, designs, images and presentations of advertisements, photographs, audio materials, videos, messages, designs of interactive instant messages and functions, files, documents, images or other materials (collectively, the “Materials”), whether publicly posted or privately transmitted, and all derivative works, are owned by CIS or third parties licensed to CIS and protected by copyright laws; trademarks, and other intellectual property laws.
The trademarks, logos, images, audio material and service marks displayed on the Sites are owned by either CIS or third parties. You agree not to post or use the Property without CHL’s prior written permission.
B. You may not copy, reproduce, republish, upload, post, transmit or distribute in any way, including by e-mail or other electronic medium, the Materials found on the Websites without the prior consent of CIS. Any modification of the Materials, use of the Materials on any website or computer network environment, or use of the Materials for any use other than personal and non-commercial use, without the prior consent of CIS, is prohibited and constitutes a violation of copyright, trademark, and other ownership rights over the Materials.
C. CIS shall solely own all right, title and interest, including all related copyrights, in and to any suggestions, ideas, feedback, recommendations, comments, postings or other information provided by You on the Sites and /or the Services (“Submissions”), and you agree to assign such Submissions to CIS free of charge. CIS may or may not use such Submissions at its sole discretion.
7. Links to Other Sites
The Websites contain links to third party websites for your convenience. You may access the Sites through links contained on third party websites. These websites are not under the control of CIS. CIS does not endorse, adopt or assume any responsibility for the content or privacy practices of third-party websites, including – without limitation – information provided on third-party websites that may lead the user to the CIS Sites. If you entered the CIS Sites through a third-party link, you remain bound by the terms and conditions of these Terms of Use. In no event can CIS be responsible for the content or other materials found or available on other websites.
8. Disclaimer of Warranties
A. You expressly agree that use of the Websites and Services is at your own risk. The websites, services and any content found on these websites or services or that can be downloaded from these websites or services are provided “as is” and “as available”. CIS disclaims all warranties, express or implied, including, but not limited to, warranties of merchantability, merchantability, fitness for a particular purpose, or non-infringement. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, PROVIDED BY YOU TO RTR OR OBTAINED THROUGH THE WEBSITES OR SERVICES SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THIS AGREEMENT.
B. CIS DOES NOT WARRANT THAT THE SERVICES OR ANY CONTENT PROVIDED THROUGH OR INCLUDED IN OR MAY BE DOWNLOADED FROM THE WEBSITES WILL MEET YOUR REQUIREMENTS, WILL BE ACCURATE, COMPLETE, CURRENT OR TIMELY, OR THAT THE WEBSITES OR SERVICES will be continuous, timely, secure or infallible. In the event that the content of the website is inaccurate, incomplete or out of date, CIS does not intentionally falsify materials or intentionally provide wrong information.
C. You understand and agree that any material and/or data uploaded or otherwise obtained through the use of the Websites or Services or other content included on the Websites or Services is at your own risk and you are solely responsible for any damage to your computer system and any loss of data resulting from uploading such materials and/or data.
D. CIS is not responsible for any loss or damage caused or alleged to have been caused, directly or indirectly, by the information or ideas contained, suggested or referred to on the websites, through the services, or by any similar use you personally make.
E. CIS and its licensors make no representation or warranty that the Websites or Services or any other content contained in or uploaded to the Websites or Services is appropriate or available for use in all geographic locations. If you use the Services outside of Greece, you are solely responsible for compliance with all applicable laws, including, but not limited to, the export and import regulations of other countries.
9. Limitation of Liability
CIS and its employees shall not be liable for any direct, indirect, incidental, special or consequential damages arising out of the use or inability to use the websites, services or content contained on the websites or services or that may be downloaded from and through them, or any information obtained on these websites, through the services, or for the cost of procuring substitute services resulting from the unauthorized access or conversion of your transmissions or data, including, and but not limited to damages for loss of profits, use, data or other intangible property even if the damages are foreseeable or if CIS has been advised of the possibility of such damages. You agree that CIS’s total liability arising out of this agreement shall not exceed the exact total amount received by CIS from you to grant you access to the Websites and/or use of the Services.
10. Indemnification
You agree to indemnify, hold harmless and hold harmless CIS, its affiliates and their properties (as well as their respective officers, directors, directors, shareholders, agents, licensors and their respective successors and assigns), from any claim, damage, costs and expenses, including reasonable attorney’s fees, arising from or related to the proper and improper use of the Websites, Services and/or any content thereof or provided by the Websites and Services, including, among others, information from third-party websites linked to the Websites through links.
11. Changes to the Websites
CIS reserves the right to modify, suspend and discontinue all or part of the Websites and/or Services at any time without notice. Unless otherwise stated, new features on the updated Websites or Services will be subject to these Terms of Use. The Websites are currently accessible to users without charge. However, CIS reserves the right to charge for access or use of any portion of the Sites or Services in the future.
12. Failure to comply with these Terms
CIS may, if deemed necessary, withdraw Your data from the Websites, warn the community of Your actions, send notices, immediately suspend or terminate Your account and any activities You engage in on the Websites, without notify You, and refuse to provide Our Services to You if You violate the Terms of Use, or if We are unable to verify or verify any information You provide Us, or if We believe that Your actions may cause financial loss or legal liability to You, CIS, other Visitors or users, or Us. CIS reserves the right, if deemed necessary, to deny, at any time, any user access to those portions of the Sites that require your registration. You agree that CIS shall not be liable to You or any third party for the termination of Your access to Materials, Content, Services and/or Websites.
13. Dispute Resolution, Governing Law, Jurisdiction
The Terms of Use shall be governed by and construed in accordance with Greek laws. Any dispute or claim that may arise out of or in relation to the Terms of Use, or the breach thereof, shall be governed by Greek law. We apply the requirements of Greek Laws regarding how we handle Personal Data wherever it is obtained, and each property under CIS’s management complies with the local privacy laws of the jurisdiction in which it is located.
Users retain the rights recognized by Greek Law no. 2472/1997 on Data Protection (as well as Law no. 2819/1000, Law no. 2774/1999, Presidential Decree 207/1998 and 79/2000 and EU Directives 95/ 46/EK and 97/66/EK) and in particular the rights related to information, access and reputation.
14. RTR Privacy Policy
CIS is committed to providing a safe environment for consumers. Although CIS is not a financial institution, CIS is committed to respecting the privacy rights of Visitors and users of the Websites.
15. In general
You and CIS are independent parties and no agency, corporation, joint venture, employer-employee or licensor-franchisee relationship is created or created by these Terms of Use.
If any provision of the Terms of Use is held invalid or unenforceable by a court of competent jurisdiction, that provision will be removed from the Terms of Use, which will remain in full force and effect. No waiver by either party of any breach or failure to perform the terms of use shall be deemed a waiver of any prior or subsequent breach or failure to perform. Paragraph headings are used for convenience only.
When you enter the websites or services, you acknowledge that you have read and understood the terms of use and agree to be bound by the terms and conditions contained therein.
